Rhode Island Proposes Gun Confiscation

While a law banning the new ownership of firearms which are not of an antique-nature (called "assault weapons" by Democrats) has already been passed, the new proposed legislation would ban the possession of these firearms, effectively instituting gun confiscation.

Importantly, the term "assault weapon" is an ambiguous phrase used by Democrats wishing to remove the right of self defense. It is often confused with the term "assault rife" which is a select fire (full auto capable) rifle with a detachable magazine and chambered for an intermediate cartridge, first developed in Germany with the STG-44, which bridged the gap between the sub-machine gun and battle rifle.

A proposed legislation in Rhode Island would effectively institute gun confiscation. At this time the bill has not yet passed the state’s House or Senate.

HB 8073 “An Act Relating To Criminal Offenses — Unlawful Sale Of Prohibited Firearms (Restricts the possession of prohibited firearms)” was introduced on February 27 and has been referred to House Judiciary Committee.

The bill’s summary details the implications, which includes a ban on possession of “prohibited” firearms:

The bill amends Section 11-47.2-2 of the General Laws regarding the unlawful sale of prohibited firearms, introducing new restrictions on the manufacture, sale, possession, and purchase of such firearms, effective July 1, 2026. Under the amended law, no person shall manufacture, sell, offer to sell, transfer, possess, or purchase a prohibited firearm.

However, individuals who lawfully possess a prohibited firearm prior to July 1, 2026, may sell or transfer it to a federally licensed dealer or to an individual outside the state who can legally possess it by December 31, 2026. The bill also allows federally licensed dealers and law enforcement agencies to engage in transactions involving prohibited firearms under certain conditions. The act is set to take effect upon passage.

Rhode Island has already passed an “assault weapons” ban which outlaws new ownership of a wide range of firearms besides those with antique designs (such as bolt action and revolvers):

The law (2025-S 0359A) bans the manufacture, purchase, sale, or transfer of military-style weapons, including certain types of semi-automatic rifles and shotguns. The law allows lawful owners to possess these firearms and allows lawful owners to sell their firearms to federally licensed dealers or individuals outside of the state who can lawfully possess them. Violations are punishable by up to 10 years in prison, a $10,000 fine, and firearm forfeiture. The law goes into effect on July 1, 2026. 

The new proposed legislation would also prohibit possession of these firearms, effectively instituting a confiscation.

Rhode Island’s Democrat Governor Dan McKee has passed a slew of unconstitutional legislation which infringes on the Second Amendment, including a ban on regular and low-capacity (more than 10 round) magazines, a law which requires firearms to be harder to access in case of an emergency, raising the legal age to purchase firearms or ammunition from adulthood at 18 to later in adulthood at 21 and prohibiting the open carry of any loaded rifle or shotgun in public.
