Obama-appointed U.S. District Judge William Orrick of San Francisco extended a preliminary injunction on Friday that blocks the Trump administration from denying funding to Boston, Chicago, Denver, Los Angeles and 30 other “sanctuary” cities and counties that refuse to enforce immigration law.
In April of this year, and in 2017, Judge Orrick issued similar injunctions blocking Trump from withholding funding to other sanctuary cities.
The judge claims President Trump withholding funds from sanctuary cities and counties is unconstitutional, saying the movie violates their Fifth and Tenth Amendments, and violates due process.
“Precedent in the Ninth Circuit and the orders of this court show why the Cities and Counties have established that they are likely to prevail on the merits of at least their separation of powers, Spending Clause, and Fifth and Tenth Amendment claims,” Orrick wrote. “The challenged sections in the 2025 Executive Orders and the Bondi Directive that order executive agencies to withhold, freeze, or condition federal funding apportioned to localities by Congress, violate the Constitution’s separation of powers principles and the Spending Clause, as explained by the Ninth Circuit in the earlier iteration of this case in 2018; they also violate the Fifth Amendment to the extent they are unconstitutionally vague and violate due process.”
The Trump DOJ has also recently sued New York, Los Angeles and other cities over their sanctuary policies.
Talk radio host Bo Snerdley, known for his longtime partnership with radio legend Rush Limbaugh, called on Congress to take action against the “rogue judges” repeatedly preventing the Trump administration from fixing America.
Democrats are hellbent on preventing the Trump administration from cracking down on illegal immigration despite the efforts having support from a majority of Americans.
