Image Credit: akinbostanci / Getty U.S. District Judge James Hanlon ruled on Tuesday that illegal alien Juan Espinoza Martinez, who was indicted for allegedly trying to pay people to murder Border Patrol Chief Gregory Bovino last year, cannot be deported by the federal government.
Martinez is allegedly a “high-ranking” member of the Latin Kings gang, according to DHS Assistant Secretary for Public Affairs Tricia McLaughlin.
Espinoza Martinez was accused of sending a message to his brother and another person a picture of Bovino, offering “2k on information when you get him” and “10k if u take him down.”
The anonymous individual in the message sent screenshots to Homeland Security investigators, hinting they may have been an informant and eventually leading to the reported gang member’s arrest.
Martinez’s attorneys argued during his trial that he never took any physical action to follow through with the “murder-for-hire” plot, and the jury agreed, reaching a not guilty verdict after three hours of deliberation.
Last month, soon after he was acquitted, Martinez was detained by Immigration and Customs Enforcement.
However, Judge Hanlon ruled he’s “at minimum entitled to a bond hearing and not subject to mandatory detention” and cannot be moved “outside the jurisdiction of the United States or transferred to any federal judicial district outside of Illinois, Indiana, or Wisconsin.”
