A federal grand jury on Tuesday refused to indict the “Seditious Six” Democrats who issued a video last year suggesting military and intelligence agency members refuse to follow “illegal orders” by the Trump administration, failing to mention what orders were allegedly illegal.
In November of 2025, Senators Elissa Slotkin (Mich.) and Mark Kelly (Ariz.), and Reps. Chris Deluzio (Pa.), Maggie Goodlander (N.H.), Chrissy Houlahan (Pa.) and Jason Crow (Colo.) all appeared in the video promoting insubordination.
Before being elected, Kelly was a captain in the U.S. Navy, Slotkin was a CIA officer, Deluzio was in the Navy, Crow was a paratrooper and Army Ranger, Goodlander was an intelligence officer and Houlahan was in the Air Force.
The Trump administration DOJ hoped to charge the politicians with seditious conspiracy, but a grand jury declined.
CBS News reports two sources revealed, “The Justice Department sought to charge the lawmakers under a criminal statute known as 18 U.S.C. § 2387. That law threatens a 10-year maximum prison sentence for anybody who ‘advises, counsels, urges, or in any manner causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty by any member of the military.’ It requires intent to ‘interfere with, impair, or influence the loyalty, morale, or discipline of the military.'”

Democrats celebrated the grand jury decision on social media, portraying the win as proof there was no wrongdoing and that the Trump admin was trying to attack free speech.
“The Trump administration’s attempt to indict six Democratic lawmakers was an outrageous abuse of power and perhaps its most brazen attack on freedom of speech so far,” wrote former Democrat presidential candidate Kamala Harris. “We should all be grateful to the citizens serving on this grand jury who saw through what the Trump Justice Department tried to do and stood up for the rule of law. Every Republican lawmaker should condemn this effort to criminalize the activity of a coequal branch of government. Today, it was Democrats being targeted by Trump — but any of them could be next.”
Senator Kelly wrote, “This is an outrageous abuse of power by Donald Trump and his lackies. It wasn’t enough for Pete Hegseth to censure me and threaten to demote me, now it appears they tried to have me charged with a crime — all because of something I said that they didn’t like. That’s not the way things work in America. Donald Trump wants every American to be too scared to speak out against him. The most patriotic thing any of us can do is not back down.”
Attorney Mike Davis accurately pointed out the fact that a “Trump-deranged” grand jury in the District of Columbia failed to indict the politicians proves nothing.
Other members of the “Seditious Six” also took victory laps.
