More than half a million Haitians will now be sent back to Haiti from the US.

On Friday, Secretary of Homeland Security Kristi Noem announced that temporary protected status (TPS) for Haiti will now be cancelled, paving the way for hundreds of thousands of Haitians to be repatriated.

According to a press release, Secretary Noem determined that conditions in Haiti have now improved enough to allow the approximately 520,000 Haitians in the US who have TPS to return. Furthermore, their continuing presence in the US has been deemed to run counter to the national interest.

“This decision restores integrity in our immigration system and ensures that Temporary Protective Status is actually temporary,” a DHS spokesperson said.

“The environmental situation in Haiti has improved enough that it is safe for Haitian citizens to return home.

“We encourage these individuals to take advantage of the Department’s resources in returning to Haiti, which can be arranged through the CBP Home app. Haitian nationals may pursue lawful status through other immigration benefit requests, if eligible.”

The TPS designation for Haiti ends on Aug. 3, 2025, and the termination will go into effect on Tuesday, September 2, 2025.

Last month, the Supreme Court ruled that it would allow the Trump administration to revoke the legal status of half a million Cubans, Nicaraguans, Haitians and Venezuelans, after a Biden-appointed judge issued a nationwide injunction preventing this.

On Friday, in a decision on birthright citizenship, the Supreme Court granted the administration’s request to limit nationwide injunctions by lower courts.

The Court ruled that US District Courts cannot issue nationwide stays and injunctions that universally prohibit a certain policy. Instead, District Courts can only issue actions that are valid within their judicial districts.

“When a court concludes that the Executive Branch has acted unlawfully, the answer is not for the court to exceed its power, too,” the majority opinion stated. The Judges who dissented were “embracing an imperial Judiciary”, it added.

A record-breaking number of nationwide injunctions, targeting every major policy of the new administration, have been issued since Trump’s returned to power.
