U.S. District Judge Indira Talwani of Boston, a Barack Obama appointee, indefinitely blocked on Monday a Trump administration policy passed in the One Big Beautiful Bill Act (BBB) that prevented many Planned Parenthood locations from being reimbursed via Medicaid if they continued performing abortions.

The preliminary injunction restored Medicaid funding for 10 Planned Parenthood affiliates, with Judge Talwani writing, “Patients are likely to suffer adverse health consequences where care is disrupted or unavailable. In particular, restricting Members’ ability to provide healthcare services threatens an increase in unintended pregnancies and attendant complications because of reduced access to effective contraceptives, and an increase in undiagnosed and untreated STIs.” 

Red State writer Bonchie pointed out, “This Biden-appointed judge ruled *Congress* can’t defund Planned Parenthood because it might lead to ‘unintended pregnancies’ and less access to contraceptives.”

The judge’s ruling came in response to a lawsuit filed by the Planned Parenthood Federation of America on behalf of all of its 47 regional Boston affiliates, along with its Utah and Massachusetts chapters.   

Talwani suggested the BBB provision was unconstitutional because it wrongly sought to inflict punishment without a trial on Planned Parenthood without a trial, stating, “Plaintiffs are likely to establish that Congress singled them out with punitive intent.”

She also claimed the bill violated Planned Parenthood’s Fifth Amendment rights of equal protection.

Planned Parenthood Federation of America President Alexis McGill Johnson issued a statement, saying, “We will keep fighting this cruel law so that everyone can get birth control, STI testing and treatment, cancer screenings, and other critical health care, no matter their insurance.”

Meanwhile, Trump administration Health and Human Services Director of Communications Director Andrew Nixon stated, “States should not be forced to fund organizations that have chosen political advocacy over patient care.”
