6-3 ruling ends majority of Trump tariffs.

Administration could seek other avenues to reimplement the economic measures.

The Supreme Court decided on Friday in a six to three ruling that President Donald Trump does not have the authority to impose a large portion of his tariff agenda.

Justices Thomas, Alito, and Kavanaugh were the only judges to dissent.

The court focused on the 1977 International Emergency Economic Powers Act (IEEPA), which the Trump administration used to impose tariffs as the act allows the president to regulate imports.

However, the court found the act doesn’t permit POTUS to enact tariffs as part of import regulations.

According to the Constitution, only Congress has the power to set tariffs, and President Trump was the first to ever use the IEEPA to set tariffs on imports. 

Trump tariffs imposed on steel and aluminum using different laws remain unaffected by the court’s decision.

The president could also attempt reimposing the tariffs nullified by the court by using other laws.

Ahead of the ruling, Trump wrote on Truth Social, “If the Supreme Court rules against the United States of America on this National Security bonanza, WE’RE SCREWED!”
